Two little things
There have occured two things in the last day that bother me from a constitutional perspective.
1. They are confiscating guns from private citizens in New Orleans. But while they are doing that they are not confiscating guns from private security forces that people have hired to protect their property. So if you can afford Blackwater security you can have a guard armed with an M-16 rifle watching your property. But you cannot, it seems, sit there an guard it yourself with your legal privately owned firearm. Just seems wrong to me.....
2. A Federal appeals court ruled today that the Federal government can detain a US citizen on US soil for an indefinate amount of time without allowing him access to attornies, trial, habeus corpus, or even being charged with a crime. This is blatently unconstitutional.

that's pretty sick about the 1st one. Guns will be the only posession they have that would actually be worth anything. In fact, when I lost all my money in internet stocks, my guns were the only things I've owned that kept their value (actually they went up).
This country's turning into an oligarchy. The more money you have, the less your Rights will be violated.
Oh yes indeed they can hold "enemy combatants" The problem is the EC is a US citizen that was detained in the US. NOw I don't care what they choose to call you but if you are a US citizen you are entitled to all of your constitutional rights.
And yes, Lincoln suspended many contitutional issues in the Civil War. Habeus Corpus being one of them and he caught hell for it. I just can't help but think though that if a US Citizen (Jose Padilla if you are wondering of whom I am speaking) is detained he is entitled to his rights. IF he is a criminal charge him and try him. IF he is a traitor, do the same thing. But locking him up and hiding him away is just wrong.
Exmi - You're right on this matter. A U.S. citizen, no matter how evil and how much of a traitor is still entitled to his Rights. The day his Rights are violated is a very bad day indeed.
